Terms and Conditions
Membership in the 180 Healthcare, LLC (“180”) is conditioned on acceptance by you of the terms and conditions contained herein. By purchasing a membership to 180 or using or continuing to use the benefits of 180, the Member is deemed to have agreed to all such terms and conditions of the Agreement.
SECTION 1: ELIGIBILITY AND ENROLLMENT
1.1. You must be 18 years old or older to enroll in the Membership for yourself and your family.
1.2. You must provide and maintain accurate and true personal information, which includes: a demographic sheet, photo ID and billing information when applying for the 180 Membership or using any 180 benefits. Failure to do so may invalidate membership in 180. It is your responsibility to update personal information by logging into the website and updating according to any changes with demographic, financial changes or contact information. The home office is located at 24 North Sprigg, Suite B, Cape Girardeau, Missouri and the telephone number is (573) 803-4661.
1.3. Membership in 180 is non-transferable. Only you or your family may use the benefits of Membership in 180. You must promptly notify 180 upon becoming aware of any unauthorized use of the Membership.
SECTION 2: MEMBERSHIP
2.1. Your Membership will include the following benefits:
a. Telehealth services provided by 1800MD.
b. Heavily reduced prescriptions
c. Nutrition app for meal planning and diet information
2.2. 1800MD. Telehealth services provides every Member access to non-emergent care. Upon enrolling in 180, Members will receive a welcome e-mail from 1800MD. Members are responsible for registering with 1800MD. After the Member completes his or her registration, 180 will send your demographic information to 1800MD. 180 will assist, if requested, with this registration during regular business hours of Monday – Thursday 8:00- 5:00. You may also contact 1-800-530-8666 to receive help from 1800MD for this part of the registration.
2.3. Heavily reduced prescription medications. Prescriptions and pricing are subject to change at any time without notice. This is a service that 180 Healthcare offers to its members and is subject to change without our notice.
2.4. You will be provided exclusive access to our Mealime Nutrition app Pro Version upon completion of your registration. You will be able to download our app on up to three devices with one login and you will get two logins per family sign up.
SECTION 3: PAYMENT
3.1. Upon enrollment, you will be charged the Membership Price, the value of which is $15.00 per month per family (living in the same household), which will be due on the anniversary date of each month.
3.2. Charges of the Membership Price are non-refundable.
3.3. The Debit Card, Credit Card or Auto Bank Withdrawal you use for your Initial Membership Price will be retained as the default payment method.
SECTION 4: MEMBERSHIP TERM AND RENEWAL
4.1. 180 reserves the right to cancel, extend or suspend Membership at its sole discretion for any reason.
4.2. The Membership term is twelve (12) months and will automatically renew for successive terms. Members will not be able to cancel their Membership during the current term. Members may withdraw from their Membership by providing written notice to the home office within 30 days of the end of the current term.
4.3. Recurring Membership is effective for a period of twelve (12) months following the renewal date in each succeeding period.
4.4. The Renewal Price will be assessed to the default payment method you authorized.
4.5. If 180 is not able to complete a charge of the Renewal Price, you will lose Membership benefits and you must enroll again.
4.6. The Renewal Price is subject to change by 180 at any time without notice. Any increase in the Renewal Fee will take effect upon the following renewal term.
4.7 Members who cancel or terminate early their Membership will be assessed a cancellation fee equal to the amount remaining and any extra expense incurred.
SECTION 5: LIMITATION OF LIABILITY
5.1. 180 accepts no liability for any losses or claims arising from any Member unable to access the Membership Benefits under 2.1, nor the actual treatment or services provided by a third-party providing Membership Benefits under 2.1. 180 shall not be liable to a Member by reason of any delay in performing, or any failure to perform, any Membership Benefit.
5.2. Member agrees and understands that he or she will be responsible for their acts, errors, statements or omissions (including family and/or any non-member accompanying the Member) at any place where a Membership Benefit may be provided, and hereby indemnifies 180 against any and all demands, claims, actions, liabilities, damages, losses and/or expenses from same.
5.3. This section applies only to the extent permitted by law.
SECTION 6: WARRANTY
6.1. 180 makes no warranties, express or implied, guarantees or conditions with respect to your use of the Membership Benefits. You understand that the use of the Membership Benefits is at your own risk. 180 doesn’t guarantee the Membership Benefits provided through its third-party providers, nor the accuracy or the timeliness of information by a third-party.
6.2. This section applies only to the extent permitted by law.
SECTION 7: CHOICE OF LAW AND JURISDICTION
The Member and 180 irrevocably consent that laws of the State of Missouri shall be used and to the exclusive jurisdiction and venue of the state or federal courts in Cape Girardeau County, Missouri, for all disputes arising out of or relating to these Terms and Conditions.
SECTION 8: MISCELLANEOUS
8.1. 180 may modify these Terms and Conditions at any time without notice.
8.2. These Terms and Conditions, and any other referenced source herein, shall constitute the entire agreement between the Member and 180.
